Products Liability

Mr. Radulski is experienced with the three main categories designated for defective products which may result in product liability claims:

1. Design Defects – flaws in the product’s conceptual design
2. Manufacturing Defects – specific defects which occur during the manufacture of the product
3. Defects in Marketing – improper instructions or failures to elucidate consumers of potential and latent dangers in the product

When a product malfunctions due to a defect and causes serious personal injury, the law requires the manufacturer, wholesaler or retailer of the product to bear the losses caused by the defect in the product.

Auto Accidents

Mr. Radulski has represented hundreds of injured automobile operators, automobile passengers, motorcyclists, bicyclists and pedestrians. His past experience as an attorney representing insurance companies has provided him the know-how to represent Plaintiffs providing a formidable advantage against the insurance companies and the negligent acts of their insureds.

Premises Liability

A premises liability claim may exist when a person is injured because of the existence of a dangerous or defective condition, existing at a store, residential home, stairwell, commercial building, parking lot, driveway, mall or restaurant. Mr. Radulski is experienced in handling premises liability claims and will take the time to explain your rights.

“Wrongful Death”

“Wrongful death” is defined as a death caused by the wrongful act of another. The wrongful act serves as a basis for a lawsuit to recover monetary damages on behalf of the decedent’s heirs. The monetary recovery includes both the economic loss and the emotional loss resulting from the death.

“First Party” Insurance Claim

The gravamen of a “first party” lawsuit is a failure by the insurance company to compensate its insured for a loss covered by the insurance policy or by unreasonably delaying benefits due under the insurance policy. If the insurance company unreasonably delays benefits due under the policy or refuses, without proper cause, to compensate its insured for a loss, and if the insurance company’s conduct was found to be knowing and willful, the insurance company could be ordered to pay triple damages including payment of attorney fees, costs and interest.

Medical Malpractice

Medical malpractice is the professional negligence of a doctor, dentist, hospital, nurse or other health care professional. A bad result due to the care and treatment of a doctor does not automatically mean that malpractice has occurred. Malpractice occurs when a health care professional negligently or unintentionally fails to follow commonly accepted or acknowledged standards of medical care. If the doctor’s deviation from the standard of care causes death or injury, a medical malpractice case may exist.

Construction Accidents

While many injured workers may be eligible for workers’ compensation benefits, damages such as pain and suffering and other non economic losses are not included under the Massachusetts Workers’ Compensation Act. However, these damages are legally compensable in separate, third party actions arising from a work-related injury. When someone causes a preventable construction accident through negligence, he or she may be liable for the victim’s injuries.

Real Estate

Mr. Radulski represents buyers, sellers, banks, and mortgage brokers in the buying and selling of residential property, homes and condominiums.
